Water Rights, Water Banking, and Permitting

Our senior professionals have extensive experience conducting due diligence; appraising water rights for buyers and sellers; facilitating the transfer of water rights to water reserve, banking and trust programs; and determining water availability and appropriation for watershed plans and long-term water supply management or comprehensive water system plans. We have structured, managed, and advised clients on water right purchase and transfer opportunities, and evaluated water rights of interest. Examples include transactions to protect flows in small, closed streams; strategies to structure water deliveries and water use to satisfy Tribal water rights, water rights acquisition for irrigation purposes, and brokerage of large municipal and industrial water rights.
ENTRIX is experienced in water right settlement agreements and conflict resolution addressing water rights asserted by Tribes, irrigators and other stakeholders. We are familiar with water rights strategies using the Winters Doctrine, federal tribal trust responsibilities, the requirements of the Endangered Species Act, and other means to effect water allocation, conservation and appropriate in river basins.
